Terms of Service

Welcome to SUNSWEAT. These Terms of Service (“Terms”) govern your use of the SUNSWEAT website, our booking and membership services, and your participation in SUNSWEAT classes, events, and studio activities. By creating an account, purchasing a membership, class pack, or drop-in, booking or attending a class, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our services.

1. Accounts & Eligibility

Each client must create and maintain their own individual SUNSWEAT account and provide accurate, current information. You are responsible for keeping your login credentials secure and for all activity under your account.

Clients under 18 may participate in certain services only with the consent of a parent or legal guardian, who must complete all required registration and waiver documents on the minor’s behalf. Participants must be at least [minimum age] years old.

2. Health, Safety & Assumption of Risk

SUNSWEAT classes are physically demanding and take place in a heated environment. Before participating, you should consult a physician, particularly if you are pregnant, have a medical condition, injury, or physical limitation, or have not exercised recently. SUNSWEAT does not provide medical advice or medical treatment.

Participation is voluntary. You understand that exercise, including heated fitness training, carries inherent risks, including the risk of injury, and you accept those risks. You agree to listen to your body, hydrate, take breaks as needed, follow your coach’s instructions, and let your coach know before class if you are new, have an injury, or need a modification.

All clients must complete SUNSWEAT’s liability waiver and release before attending their first class. SUNSWEAT may decline or discontinue a client’s participation if we believe it is unsafe.

3. Memberships, Class Packs & Payments

Current memberships, class packs, drop-ins, and pricing are listed on our Pricing page. Prices and offerings may change; changes to an existing membership’s rate will be communicated in advance where required.

• Recurring monthly billing. Monthly memberships automatically renew each month on the original billing date until canceled by the member.
• No long-term commitment. Memberships are month-to-month and may be canceled anytime through the SUNSWEAT app. Cancellations take effect at the end of the current billing period, and no partial-month refunds are provided.
• Founding memberships. Founding rates remain locked while the membership remains active. If a Founding membership is canceled, the founding rate is forfeited and cannot be reinstated.
• Intro offer. Introductory offers are for new clients only, are one-time use, and are valid for 30 days from the date of purchase unless otherwise stated.
• Class packs and drop-ins. Class packs and drop-in classes are valid for one year from the date of purchase unless otherwise stated.
• Payments are final. Membership, class pack, and drop-in payments are non-refundable once processed. Unused or expired class credits will not be refunded, transferred, extended, or converted to cash or account credit.
• Payment method. You are responsible for maintaining a valid payment method on file. If a payment fails, SUNSWEAT may restrict class booking and membership access until the outstanding balance is resolved.

Payments are processed by our third-party payment provider, Stripe. Account, booking, and membership services are provided through Mariana Tek. Your use of those services is also subject to their terms and policies.

4. Membership Pause

Members may pause their membership for temporary breaks. Pause requests must be submitted to SUNSWEAT in advance and cannot be applied retroactively. During an approved pause, membership billing and class access are suspended for the approved pause period, and both automatically resume when the pause period ends.

5. Booking, Cancellations & Late Arrivals

Classes must be booked in advance through the SUNSWEAT app or website. Reservations must be made under the account of the person attending class.

To honor our coaches and community, please cancel your reservation at least 6 hours before class. Late cancellations and no-shows are subject to the following:

• All-Access Members: a $10 late-cancellation or no-show fee will apply.
• Momentum 8 & Essential 4 Members: one class credit will be forfeited.
• 10-Class Pack & Drop-In Clients: one class credit will be forfeited.

Cancellations made 6 or more hours before class will not incur a penalty. Frequent late cancellations or no-shows may result in temporary booking restrictions.

Studio doors are unlocked 15 minutes before each class and close promptly at the scheduled start time. Once class begins, we are unable to accommodate late arrivals, and the late-cancellation policy above applies.

6. Guest Passes & Sharing

Memberships, class packs, drop-ins, class credits, and other purchased services are intended solely for the account holder and may not be shared, transferred, or resold. Clients may not book classes under another person’s name or use another client’s membership or class credits.

Guest passes are intended for the member’s invited guest and may not be transferred, sold, or exchanged for cash or account credit. Guests must create their own SUNSWEAT account and complete all required registration and waiver requirements before attending class.

7. Studio Conduct

We ask every client to help keep SUNSWEAT a calm, clean, and welcoming space: arrive on time, silence and store your phone during class, wipe down your equipment and mat area after class, return equipment where it belongs, keep outdoor shoes in the lobby, and be mindful of others and their personal space.

SUNSWEAT may refuse service, cancel bookings, or suspend or terminate an account for conduct that is unsafe, disruptive, disrespectful, or in violation of these Terms. SUNSWEAT is not responsible for lost, stolen, or damaged personal belongings.

8. Schedule Changes

SUNSWEAT may change class schedules, formats, coaches, or studio hours, and may cancel classes when necessary. If SUNSWEAT cancels a class you have booked, any class credit used for that booking will be returned to your account.

9. Photography & Video

SUNSWEAT may photograph or record classes, events, and studio activities as described in our Privacy Policy. Any separate photography/video consent or release you provide will govern the use of your image or likeness. If you have a concern about appearing in a particular photograph or recording, please contact SUNSWEAT.

10. Retail & Additional Purchases

All retail, merchandise, and in-studio purchases are final sale.

11. Website & Intellectual Property

The SUNSWEAT website and its content, including the SUNSWEAT name, logos, class names, text, graphics, photographs, and design, are owned by or licensed to SUNSWEAT and protected by applicable law. You may not copy, reproduce, distribute, or use this content for commercial purposes without our written permission.

Our website may link to third-party websites and services, including Mariana Tek and Stripe. SUNSWEAT is not responsible for the content, policies, or practices of third-party websites or services.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy.

13. Disclaimers & Limitation of Liability

Our website and services are provided “as is” and “as available.” To the fullest extent permitted by law, SUNSWEAT disclaims all warranties, express or implied, and will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Nothing in these Terms limits any liability that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify and hold harmless SUNSWEAT, its owners, coaches, employees, and contractors from claims, losses, and expenses arising from your violation of these Terms or your misuse of our services, to the extent permitted by law.

15. Governing Law

These Terms are governed by the laws of the State of Ohio. Any dispute arising from these Terms or our services will be brought in the state or federal courts located in Wood County, Ohio, unless applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date above. Your continued use of our services after changes take effect means you accept the updated Terms.
